Complete "Living Trust Package" includes:

​Living Trust Document:

• Lets family inherit your property without going through probate court
• Avoid probate and may also let your heirs avoid federal taxes after your death (only with very large estates)
• Name executors and beneficiaries of your estate
• Designate specific distribution of your estate property
• Create sub trust for minor beneficiaries or create Special Needs sub trust beneficiaries with special needs.
• Preparation of one Trust Transfer Deed (additional Deeds are $120/each, $150/each for out of state)

Certification of Trust:

• A shorter version of your Living Trust, primarily used to transfer property into your trust document

​Pour Over Will(s):

• States that all property at the time of death shall be transferred to the Trustee of the trust. Example, an inadvertent failure to transfer real property to the Trust.
• Name guardian to care for children
• Forgive debts to others​

Advanced Healthcare Directive (included in this Package OR $150 separately):

• If you are concerned about the kinds of medical treatment you may receive at the end of your life.  Plus, a HIPAA Release Authorization.
• Other issues concerning your natural death
• Consider appointing someone to carry out your wishes

Durable Power of Attorney for Finances (included in this Package OR $150 separately):

• If you are elderly or in poor health, you may be concerned about who will handle your day-to-day financial matters
• A durable power of attorney gives a person you choose legal authority to manage your property on your behalf if you become incapacitated

Final Arrangements (included in this Package OR $150 separately):

• How will your family pay for your funeral?
• What will happen to you after your death?
• Do you prefer burial or cremation?
• What about the ceremony?  Do you want one?
• Give wishes and desires

Last Will & Testament:

• States who you want to inherit your property at the time of your death. 
• Name an Executor to carry out your wishes
• Name guardian to care for children
• Forgive debts to others

NOTE: A Will "DOES NOT" prevent Probate. To avoid Probate, a Living Trust is the best option.

Amendments, Codicils, Deeds and Special Needs

Amendments - Making changes to your existing Living Trust document. Service fees typically range from $200-$300
Codicil - Minor changes to your Last Will & Testament.  Service fees typically range from $200-$300.
Amendment and Restatement - Completely replaces an outdated Living Trust with new language and decisions.
Deed - Add or remove a person from title to real property you own. Service fees are $120 to $150 per deed, plus notary and recorder's fees.
Special Needs Trust - Ensures your disabled adult child can inherit property and not loose their governmental benefits.  Service fee is $200 when added to a Living Trust or Estate Plan Package.

Probate and Conservatorship Services

Full Probate

• Process of administering a dead person's estate. This involves organizing their money, assets and possessions and distributing them as inheritance – after paying any taxes and debts.
• Service fee is $4,500, plus court file fees and other costs ($2,500 due up front to get started)

Affidavit for Collection of Personal Property

• Used by successors in interest to a person who died to collect personal property totaling $184,500 or less in California. It cannot be filed until 40 days have elapsed since the person died.
• Service fee is $350, plus notary fees

Spousal Property Petition

• Transfer or confirm property to a surviving spouse without a full probate proceeding
• Service fee is $1,200, plus court file and recorder's fees

Petition to Determine Succession to Real and Personal Property

• Used by successors in interest to a person who died to collect real and personal property totaling $184,500 or less in California. It cannot be filed until 40 days have elapsed since the person died.
• Service fee is $1,200, plus court file fees, recorder's fees and property appraisal fee

Heggstad Petition

• Avoid potentially expensive and time-consuming probate proceeding. It is used when an asset or property owner dies with the asset still in the property owner’s name, even though he or she intended to transfer it to a trustee.
• Service fee is $800-$1200, plus court file fees and recorder's fees

Conservatorship (Limited)

• Court proceeding where a judge gives a responsible person, called a limited conservator, certain rights to care for another adult who has a developmental disability
• Service fee is $850, plus court file fees and other costs
